ACCEPTABLE USE POLICY

This Acceptable Use Policy ("Policy") describes the rules and guidelines for using AsterMind-ELM services and software (collectively, the "Services") provided by AsterMindAI Corporation ("AsterMind", "we", "us", or "our").

This Policy is part of, and subject to, the Terms of Service and End User License Agreement ("EULA").
Limitations of liability, disclaimers, and indemnification obligations in those agreements fully apply to this Policy and any violations of it.

Violation of this Policy may result in immediate suspension or termination of your access to the Services.

1. PROHIBITED USES

1.1. Illegal Activities

You may NOT use the Services to:

• Violate any applicable laws, regulations, or legal obligations
• Engage in fraud, theft, or other criminal conduct
• Infringe on copyrights, patents, trademarks, or other IP rights
• Violate privacy, data protection, or consumer protection laws
• Engage in money laundering or terrorist financing
• Violate export controls, embargoes, or trade sanctions

1.2. Harmful or Malicious Activities

You may NOT use the Services to:

• Transmit, store, or distribute malicious code, viruses, or malware
• Attempt hacking, unauthorized access, or security breaches
• Conduct denial-of-service attacks or disrupt systems
• Interfere with or compromise the security or integrity of networks
• Collect or harvest information without authorization
• Conduct phishing, spoofing, or social-engineering activities

1.3. Content Restrictions

You may NOT use the Services to process, store, or transmit:

• Illegal content or content that violates applicable law
• Content that infringes intellectual property rights
• Defamatory, libelous, or misleading content
• Threatening, harassing, or abusive content
• Discriminatory or hateful content
• Obscene, pornographic, or sexually explicit content
• Content that promotes violence or unlawful acts
• Content that violates privacy, confidentiality, or contractual obligations

1.4. System Abuse

You may NOT:

• Reverse engineer, decompile, disassemble, translate, or otherwise attempt to derive the source code, algorithms, or underlying ideas of the Services, except to the extent expressly permitted by applicable law notwithstanding this prohibition
• Circumvent or attempt to circumvent license validation or security measures
• Share, sell, sublicense, or transfer your license key to unauthorized parties
• Use automated systems to access the Services without authorization
• Overload, interfere with, or abuse AsterMind systems or infrastructure
• Disrupt or impair use of the Services by other users

1.5. License Violations

You may NOT:

• Use the Services without a valid, active license
• Share or reuse license keys without authorization
• Use the Services beyond the licensed scope or permitted number of devices
• Modify, fork, or create derivative works of the Services without authorization
• Remove or alter proprietary notices or markings
• Replicate, imitate, or extract core functionality to develop competing products

2. RESPONSIBLE USE

2.1. Compliance

You agree to:

• Comply with all applicable laws and regulations
• Respect intellectual property rights
• Use the Services only as documented
• Report vulnerabilities responsibly
• Follow all Service usage guidelines

2.2. Data Responsibility

You are responsible for:

• Ensuring you have rights to process all data through the Services
• Complying with data-protection laws (GDPR, CCPA, etc.)
• Implementing appropriate security measures
• Maintaining backups for your own data
• Obtaining required consents for data processing

2.3. License Management

You agree to:

• Keep your license credentials confidential
• Prevent unauthorized access to your license keys
• Use licenses only on authorized systems
• Notify AsterMind of any suspected misuse
• Comply with all license scope and limitations

3. COMPETITIVE USE

3.1. Prohibited Competitive Activities

You may NOT use the Services to:

• Replicate, reproduce, or materially imitate proprietary features, algorithms, workflows, or designs of the Services for the purpose of developing a directly competing product
• Reverse engineer the Services to extract proprietary methods or models
• Conduct benchmarking for competitive intelligence or publication
• Extract datasets, embeddings, or system outputs for model cloning

3.2. Permitted Competitive Use

You MAY use the Services to:

• Build applications that use Astermind-ELM as a component
• Develop products that depend on or integrate with Astermind-ELM
• Create downstream applications that add new functionality
• Perform internal evaluations not intended for competitive misuse

4. HIGH-RISK USE CASES

4.1. Prohibited High-Risk Applications

You may NOT use the Services for:

• Life-critical systems (medical, surgical, aviation, emergency control) without explicit written approval signed by an authorized AsterMind officer
• High-frequency trading or financial systems without disclosures
• Physical systems that could cause bodily harm or property damage
• Applications violating safety, compliance, or regulatory requirements

4.2. High-Risk Use Requirements

If you intend to use the Services for high-risk applications:

• You must request approval from AsterMind
• Approval may be granted or denied in our sole discretion
• You must implement appropriate safeguards, monitoring, and redundancies
• You acknowledge the Services are provided "as-is" without warranties
• You assume full responsibility for any resulting impacts, damages, or failures

5. MONITORING AND ENFORCEMENT

5.1. Monitoring

We may:

• Monitor usage to ensure compliance with this Policy
• Review license validation and activation patterns
• Analyze usage for security, operational health, and fraud prevention
• Investigate any suspected violations

You acknowledge that you have no reasonable expectation of privacy in your use of the Services except as described in our Privacy Policy.

5.2. Enforcement Actions

If we determine you violated this Policy, we may:

• Issue warnings or compliance requests
• Suspend or terminate access immediately
• Revoke or disable license keys
• Decline refunds
• Pursue legal action, including damages or injunctive relief

Include as much detail as possible. We will investigate and take appropriate action.

6. CONSEQUENCES OF VIOLATION

6.1. Immediate Actions

Violations may result in:

• Immediate suspension of access
• Termination of licenses and accounts
• Permanent revocation of license keys
• No refunds for terminated subscriptions

6.2. Legal Consequences

Severe or intentional violations may result in:

• Civil claims or lawsuits
• Reporting to law enforcement
• Recovery of damages
• Injunctive relief

7. COOPERATION WITH AUTHORITIES

7.1. Legal Requests

We may:

• Comply with lawful requests from authorities
• Provide information when required by law
• Cooperate with investigations into illegal activities
• Protect our rights, users, and the public

7.2. Your Cooperation

You agree to:

• Cooperate with inquiries into suspected violations
• Provide information when legally required
• Comply with legal processes

8. CHANGES TO THIS POLICY

8.2. Continued Use
